This Policy describes the types of information we may collect from you or that you may provide to use when you when you visit our website www.kometusa.com (“Website”), or use or interact with any of our features on the Website, use the services we offer, purchase our products or services, or interact with our marketing, advertising or events (collectively, the “Services”).  This Policy describes our practices when  collecting, using, maintaining, protecting, and disclosing personal  information, and your rights in relation to such information. In addition to this Policy, your use of this Website or the Services may be governed by other agreement(s), such as purchase orders or our General Terms and Conditions of Sale between you and the Company.

This Policy applies to all information collected:

  • When you use or interact with our Website or any of the Services;
  • In voice communication, email, text, chat, forum, and other electronic messages between you and the Company or through the Website;

If there are any terms, policies, or practices in this Policy that you do not agree with, you must discontinue use of our Website and Services, including but not limited to, making purchase orders, or interacting with other features offered through the Website from time to time. Children Under the Age of 16.

The Website is not intended for children under 16 years of age. No one under age 16 may provide any information to or on the Website, any of its features, or through any of our Services, including but not limited making purchases or creating a user account. We do not knowingly collect personal information from children under 16. Information We Collect About You and How We Collect It.

  • Directly from you when you use our Website or Services or when you interact with our employees, sales partners, service and support representatives, or when you make purchases or make any support or product inquiries, create an account, leave reviews, or interact with us in other ways;

  • To send you text communications. You have the choice to opt-in to receiving text messages and alerts on the mobile phone number(s) you have shared with us. Once you have opted-in, we and/or our third-party marketing partners may send you text messages (i) regarding your account; (ii) to investigate or prevent fraud; and (iii) to alert you in the event of an emergency. We may send you text messages and alerts using autodialed technology. We will not contact you via text messages or alerts for marketing purposes without your prior express written consent. You do not have to opt-in to text messages and alerts to use and enjoy our Website and Services. If you opt-in, standard text messaging charges may apply. Once you opt-out, you will not receive any text messages via your mobile phone. Please keep in mind that if you opt-out of receiving text messages and alerts we may not be able to contact you with important messages regarding your account. However, if there is an emergency or account question, we will make every attempt to contact you in other ways, such as by email or on a landline phone. Unsubscribing from our marketing email or text communications will not affect our service to you.
  • Targeted Advertising. If you do not want us to use information that we collect or that you provide to us to deliver advertisements according to our advertisers’ target-audience preferences, you can opt-out by disabling cookies and other tracking technologies and view in private browsing mode.
We do not control third parties’ collection or use of your information to serve interest-based advertising. 5. ACCESSING AND CORRECTING YOUR INFORMATION

If you would at any time like to review or change the information in your account or terminate your account, you can contact us using the contact information provided below (see below Contact Information). We may not accommodate a request to change information if we believe that change would violate any law or legal requirement or cause the information to be correct. Upon your request to terminate your account, we will deactivate or delete your account and information from our active databases. However, some information may be retained in our files to prevent fraud, troubleshoot problems, assist with any investigations, enforce our General Terms and Condition of Sale and/or comply with legal requirements.

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you.  Making a verifiable consumer request does not require you to create an account with us. However, we do consider requests made through your password protected account sufficiently verified when the request relates to personal information associated with that specific account. We will only use personal information provided in a verifiable consumer request to verify the requestor's identity or authority to make the request.

6. DATA SECURITY

In Short: We aim to protect your personal information through a system of organizational and technical security measures, and we keep your information only for as long as necessary to fulfill the purposes outlined in this Policy unless otherwise required by law.

We have implemented reasonable technical and organizational security measures designed to secure the security of any personal information we process from accidental loss and unauthorized access, use, alteration, and disclosure. Please note that all payment transactions and information are processed and stored by our third-party payment processor. We do not process, maintain, or store any payment information. The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of the Website, you are responsible for keeping this password confidential. This California Consumer Privacy Act Disclosure (this “Disclosure”) supplements and is incorporated into the information contained in this Policy above, and applied solely to all visitors, users and others who reside in the State of California. We do not collect the following categories of personal information as established by the California law:

Disclosure of Personal Information for Business Purpose.

Verification of Your Identity.  Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your personal information. You may only make a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must:
  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected information or an authorized representative of such person. Please note that for any requests relating to personal information concerning sensitive data, we may require more verification information to reasonably verify your identity with a high degree of certainty and request a sworn declaration confirming such request; and
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.
We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you.  Making a verifiable consumer request does not require you to create an account with us. However, we do consider requests made through your password protected account sufficiently verified when the request relates to personal information associated with that specific account. We will only use personal information provided in a verifiable consumer request to verify the requestor's identity or authority to make the request.

Response Timing.  We endeavor to respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time (up to 90 days), we will inform you of the reason and extension period in writing. Any disclosures we provide will only cover the twelve (12) month period preceding the verifiable.

No Sale of Personal Information. In the twelve (12) months prior to the date of this Disclosure, we have not sold any personal information of users, visitors, users or consumers, as those terms are defined under California Law.

Non-Discrimination.  The Company will not discriminate against you or any consumer for exercising any of your California Consumer rights.
